These Terms of Service ("Terms") govern your access to and use of AirPulse.ai (the "Service"), operated by Airmeet Inc. ("Airmeet," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using the Service, you confirm that you are at least 16 years of age and have the legal authority to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Service

AirPulse is an AI-powered brand answer engine optimisation platform that helps businesses monitor, analyze, and optimize their brand visibility across AI-generated answers and search engines. The Service includes brand tracking, content analysis, competitive intelligence, content generation, and reporting features.

3. Account Registration

To access the Service, you must create an account and provide accurate, complete information. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Promptly notifying us of any unauthorized use of your account

4. Acceptable Use Policy

You agree not to use the Service to:

• Violate any applicable laws, regulations, or third-party rights
• Submit false, misleading, or fraudulent brand information
• Attempt to reverse-engineer, decompile, or disassemble the Service
• Interfere with or disrupt the Service or its underlying infrastructure
• Use the Service to generate content that is harmful, abusive, defamatory, or illegal
• Scrape, crawl, or collect data from the Service through automated means without our written consent
• Share your account credentials or allow unauthorized access to your account
• Use the Service to monitor brands or entities without legitimate business interest
• Circumvent any rate limits, access restrictions, or security measures

5. Intellectual Property

5.1 Our Property

The Service, including its design, features, algorithms, and underlying technology, is owned by Airmeet Inc. and protected by intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, logos, or branding.

5.2 Your Content

You retain ownership of the content you submit to the Service (brand data, URLs, text content). By submitting content, you grant us a limited, non-exclusive license to use, process, and analyze such content solely to provide and improve the Service.

5.3 Generated Content

Reports, analyses, and content generated by the Service using AI models are provided for your use. You are responsible for reviewing and verifying any AI-generated content before use.

6. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted or error-free operation. We may:

• Perform scheduled maintenance with reasonable advance notice
• Temporarily suspend the Service for emergency maintenance or security issues
• Modify, update, or discontinue features with reasonable notice

We are not liable for any downtime, data loss, or service interruptions, whether planned or unplanned.

7. Third-Party Services

The Service integrates with third-party providers (including OpenAI, Perplexity, Clerk, and Firecrawl) to deliver AI-powered features. Your use of the Service is also subject to the terms and policies of these third-party providers. We are not responsible for the practices or availability of third-party services.

8. Payment and Subscription

Certain features of the Service may require a paid subscription. Payment terms, pricing, and billing cycles will be communicated at the time of purchase. All fees are non-refundable unless otherwise stated or required by applicable law.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AIRMEET INC. AND ITS DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Damages arising from AI-generated content, analyses, or recommendations
• Service interruptions, data loss, or unauthorized access

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT AI-GENERATED ANALYSES OR CONTENT WILL BE ACCURATE, COMPLETE, OR RELIABLE.

11. Indemnification

You agree to indemnify and hold harmless Airmeet Inc. from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

12. Account Termination

By you: You may terminate your account at any time by contacting us at support@airpulse.com or through your account settings.

By us: We may suspend or terminate your account if:

• You violate these Terms or the Acceptable Use Policy
• Your account has been inactive for more than 12 months
• We reasonably believe your use poses a security risk to the Service
• Required by law or regulatory requirement

Upon termination, your right to access the Service ceases immediately. We will retain your data in accordance with our Privacy Policy.

13. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in Bangalore, India.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
